Public Offer
Terms for the provision of Body Health information and consultation services in the field of telemedicine.
1. General Provisions
1.1. This document constitutes an official offer (public offer) by Body Health (the "Provider") to enter into an agreement for the provision of information and consultation services in the field of telemedicine (the "Agreement") with any individual who accepts this offer, hereinafter referred to as the "Client" or "Patient".
1.2. This Public Offer has been developed in accordance with the principles of international contract law, applicable consumer protection legislation, electronic commerce regulations, data protection law including GDPR (Regulation (EU) 2016/679), and telemedicine standards.
1.3. Unconditional acceptance of the terms of this Offer shall be deemed to occur when the Client makes payment for the Services on the Provider's website. By making payment, the Client confirms that they have read the terms of the Offer, understand their content, and the legal consequences of concluding the Agreement.
1.4. The Agreement concluded on the basis of acceptance of this Offer constitutes a contract of adhesion. The Client confirms that they have read the terms of the Offer, understand their content, and the legal consequences of concluding the Agreement.
2. Definitions
2.1. In this Offer, the following terms shall have the meanings set out below:
- Provider - Body Health, providing Services through the Website under the trademark "Body Health".
- Client (Patient) - a legally capable individual aged 18 or over who has registered on the Website and accepted the Offer.
- Website (Platform) - https://body-health.care, the official source of information and platform for the provision of Services.
- Services - a set of informational and consultation services of a medical nature (telemedicine), provided remotely using information and communication technologies.
- Telemedicine - a set of organisational, technological, and financial measures ensuring the delivery of medical assistance and medical services remotely.
- Medical Curator - a qualified specialist with a medical degree who coordinates the delivery of Services to the Client.
- Subscription - a service format providing access to the service for a defined period (month) with automatic renewal.
- Automatic Charge (Recurring Payment) - regular automated charges from the Client's bank card for subscription renewal.
3. Subject Matter and Description of Services
3.1. The Provider undertakes to provide the Client with paid information and consultation services in the field of healthcare (Health Tech / Telehealth) in accordance with the selected tariff plan, and the Client undertakes to accept and pay for such services.
3.2. Services are provided exclusively remotely. The scope of services is strictly regulated and depends on the selected Package:
3.2.1. Package "Healthcare"
Cost: $250/month
Basic package for regular medical supervision and preventive care.
- Initial Assessment (once upon entry): 60-minute consultation with a General Practitioner, detailed analysis of previous examinations and medical history, development of an individual care plan, and referral for additional examinations as necessary.
- GP Consultations: 1-2 scheduled consultations per month, 30-40 minutes each. Includes results analysis, treatment plan adjustment, and lifestyle recommendations.
- Telemedicine and Support: Unlimited chat access with the physician and administrator. Guaranteed response time within 2 hours.
- Health Coordination: Referrals for in-person specialist examinations, assistance with accessing medical infrastructure, and prescription support.
- Specialist Consultations: Up to 2 consultations per month with specialists such as a cardiologist, endocrinologist, neurologist, psychotherapist, rehabilitation specialist, and others.
- Medical Council: 1 multidisciplinary council per month.
- Lifestyle Support: Dietitian and rehabilitation specialist consultations.
- Health Monitoring: Remote monitoring of key health indicators entered by the Client.
3.2.2. Package "Ambulance"
Cost: $500/month
Extended package for complex clinical cases, chronic conditions, and priority support.
- Initial Assessment (once upon entry): Extended 60-minute GP consultation, comprehensive anamnesis collection, in-depth risk assessment, and strategic care plan development.
- GP Consultations: 1-2 scheduled consultations per month plus additional consultations as needed.
- Specialist Consultations: Extended access with up to 5 consultations per month.
- Medical Councils: Up to 3 councils per month.
- Priority Chat: Guaranteed response within 1 hour. Emergency video consultation within 24 hours.
- Weekly Health Monitoring: With detailed reporting.
- Extended Dietitian Consultation: Including a nutrition plan.
- Emergency Protocol Development: For chronic conditions.
- Coordination: With the Client's treating physicians.
3.2.3. Service "HealthCheckup"
Cost: $100 (one-time payment)
Comprehensive one-time health assessment and future strategy development.
- Initial GP Consultation: 40-60 minutes. Detailed medical history, complaint assessment, lifestyle analysis, and risk factor identification.
- Document Analysis: Thorough review and professional interpretation of available test results, medical records, and prior consultations.
- Health Indicators Assessment: Comprehensive assessment of current status including blood pressure, weight, physical activity level, sleep quality, stress level, and glucose.
- Risk Screening: Comprehensive health assessment across 5 key areas: cardiovascular, metabolic, neurological, oncological, and psychosomatic risks.
- Diagnostic Plan: Development of a step-by-step examination plan and specialist consultation roadmap.
- Lifestyle Recommendations: Personalised guidance on nutrition, physical activity, sleep hygiene, and stress management.
- PDF Medical Report: Detailed written health assessment report delivered within 48 hours.
- Follow-Up Consultation: 30-minute follow-up consultation to discuss the report.
- 20% discount on a subsequent "Healthcare" or "Ambulance" subscription purchase.
4. Procedure for Concluding the Agreement
4.1. The Agreement is deemed concluded from the moment the Client successfully pays for the selected Service package.
4.2. The procedure for concluding the Agreement includes the following stages:
- Registration of the Client on the Website and creation of a Personal Account.
- Preliminary session with a system coordinator to determine needs and service suitability, if required.
- Selection of the appropriate tariff plan.
- Review of the terms of this Offer and the Privacy Policy.
- Payment via the integrated payment gateway.
4.3. After payment, a transaction confirmation is sent to the Client's email address, which serves as confirmation of the conclusion of the Agreement.
5. Age Restrictions and Identification
5.1. Services are provided exclusively to individuals who have reached the age of majority, namely 18 years. By accepting this Offer, the Client confirms and guarantees that they are 18 years of age or older.
5.2. The Provider reserves the right to request age verification from the Client at any time. In case of refusal or discovery of false information, the Provider has the right to immediately suspend the provision of Services without refunding the remaining period.
5.3. The Client bears full legal responsibility for providing false information about their age.
6. Payment Terms
6.1. The cost of Services is determined in accordance with the tariffs set out in Section 3. Payment is made exclusively by non-cash means using Visa/Mastercard bank cards through the integrated payment gateway.
6.2. Prices are stated in US dollars (USD). Charges are made in the local currency at the commercial exchange rate of the payment system at the time of the transaction.
6.3. The Provider does not collect or store Client bank card data. Payment data processing is performed on the secure servers of the certified payment system, compliant with the PCI DSS standard.
6.4. Payment is deemed completed at the moment funds are credited to the Provider's account.
7. Subscription and Automatic Charges
7.1. The "Healthcare" and "Ambulance" packages are provided on a subscription basis with automatic monthly renewal.
7.2. By making the first subscription payment and agreeing to the terms of this Offer, the Client grants the Provider and the payment system explicit consent for automatic charges from their bank card in the amount of the applicable tariff each subsequent billing month.
7.3. The charge date corresponds to the date of the first payment. The Client receives an email notification 3 days before each charge. If a scheduled charge fails, the system will make 3 retry attempts at 24-hour intervals.
7.4. After the third failed attempt, access is suspended and the subscription is considered cancelled.
8. Provider's Rights and Obligations
8.1. The Provider shall deliver Services of appropriate quality, engage qualified medical professionals, ensure technical platform support, maintain data confidentiality, and notify the Client of material changes at least 7 days in advance.
8.2. The Provider may amend Service prices for new billing periods, temporarily suspend the website for maintenance, engage third parties to fulfil obligations, and refuse Services or terminate the Agreement for breach of terms.
9. Client's Rights and Obligations
9.1. The Client shall provide accurate and complete health information, pay for Services on time, not share Personal Account access with third parties, and not use the Service for life-threatening emergencies.
9.2. The Client may receive Services in full scope, request information about specialist qualifications, contact support, and cancel the subscription in accordance with the Refund Policy.
10. Medical Disclaimer
Important: services are exclusively informational and consultative in nature. They do not replace emergency medical services.
10.1. The Services provided are exclusively informational and consultative in nature. They do not replace an in-person physician visit, physical examination, instrumental diagnostics, or emergency medical services.
10.2. In the event of life-threatening conditions such as acute pain, loss of consciousness, bleeding, trauma, or signs of stroke or heart attack, the Client must immediately contact emergency medical services or the nearest medical facility.
10.3. The Provider is not liable for any adverse health consequences resulting from the use of provided recommendations as the sole method of treatment or from ignoring the recommendation to seek in-person medical care.
11. Confidentiality of Medical Data
11.1. The Client's medical data constitutes special category data within the meaning of Article 9 of GDPR and applicable data protection legislation. Such data is stored in encrypted form using modern data protection technologies.
11.2. Access to medical data is restricted exclusively to the personal Medical Curator and specialist physicians engaged in the Client's case. All specialists sign strict non-disclosure agreements.
11.3. Technical measures prevent downloading or storing medical data on personal devices. Medical data is retained for the duration of the Agreement and for 3 years following its termination, after which it is anonymised or deleted.
12. Personal Data Processing
12.1. By accepting this Offer, the Client provides full and unconditional consent to the collection, processing, and use of their personal data for the purpose of providing Services. Data processing is carried out in accordance with the Privacy Policy and applicable data protection legislation, including GDPR.
12.2. The Website uses cookies and Google Analytics for user behaviour analysis using anonymised data. The Client may opt out of non-essential cookies at any time.
12.3. Personal data is not transferred to third parties except to the payment system to the extent necessary to process transactions and where required by applicable law.
12.4. The Client has all rights of a data subject under GDPR, including the right of access, rectification, erasure, restriction of processing, data portability, and the right to object.
13. Intellectual Property
13.1. All content on the Website, including texts, graphics, methodologies, algorithms, and software code, is the intellectual property of the Provider and is protected by applicable law.
13.2. The Client is prohibited from copying, reproducing, or commercially using Website materials without the Provider's written consent.
14. Liability
14.1. The Provider's liability to the Client is limited to the amount actually paid by the Client for the current billing period.
14.2. The Parties are released from liability in force majeure circumstances beyond their reasonable control.
14.3. The Client bears full responsibility for the consequences of providing false health information.
15. Term and Amendments
15.1. This Offer comes into force from the moment it is published on the Website and remains in effect until the Parties have fully performed their obligations.
15.2. The Provider reserves the right to amend the terms of this Offer unilaterally, notifying the Client via the Website at least 7 days before the changes take effect. Continued use of Services constitutes acceptance of the updated terms.
16. Dispute Resolution
16.1. All disputes and disagreements shall be resolved through negotiations. The pre-trial claim period is 30 days.
16.2. If a dispute cannot be resolved through negotiations, it shall be submitted to a competent court in accordance with applicable law and the rules on jurisdiction.
16.3. Consumers within the EU may submit complaints to the relevant national consumer protection authority or use the EU ODR platform at https://ec.europa.eu/consumers/odr.
